District News: Important Letter from Dr. Spence Regarding Cell Phone & Internet-Enabled Device Policy

As we prepare for the upcoming school year, I want to inform you about an important change taking effect in all New York State public schools, including here in Utica.

As part of the 2025-26 New York State budget, new legislation now requires that school districts implement a bell-to-bell restriction on student use of internet-enabled devices, including cell phones. This is a statewide mandate designed to support student learning, minimize distractions, and promote a healthier, more focused school environment.

In Utica, we recognize the importance of providing every student with a safe and welcoming learning space, one where they can focus on academics, engage with their peers, and develop socially and emotionally. Research indicates that excessive access to cell phones during the school day can lead to decreased attention, increased anxiety, and can have a negative impact on school culture.

In response to the new law and in alignment with our district values, we are implementing the following procedures beginning on the first day of school in September:

  • All students in grades K–12 will be required to turn in internet-enabled devices upon arriving at school each day.
  • Middle and High School students (grades 7–12) will turn in devices upon entry. Devices will be stored securely in designated, locked cabinets for the duration of the school day.
  • Elementary students (grades K–6) will turn in devices upon arrival to their classroom. These will also be secured in locked storage.

Devices will be returned to students at the end of the day prior to dismissal. These procedures apply to cell phones, smartwatches, tablets, and other internet-enabled devices.

The Utica City School District’s Code of Conduct Committee revised the 2025-2026 Board-approved Code of Conduct to include progressive discipline for students who violate the new policy. The steps are listed below:

  • 1st Offense: Device is confiscated and returned to the student at the end of the day. Parents are notified.
  • 2nd Offense: Parents must pick up the device.
  • 3rd Offense: Detention is assigned. Parent pickup required.
  • 4th Offense and beyond: Additional consequences per the Code of Conduct.

We want to assure families that all classrooms are equipped with instructional technology, including Chromebooks. There is no academic need for students to use their personal devices during the school day.

FAQ: Cell Phone & Internet-Enabled Device Policy (Effective Fall 2025)

We’ve compiled answers to some of the most common questions families may have about the new policy:

 

Why is this policy being implemented?

This is a new statewide law passed as part of the 2025–26 New York State Budget. It requires all school districts to restrict student access to internet-enabled devices during the entire school day. The goal is to reduce distractions, support mental health, and promote better academic and social outcomes.

 

What counts as an internet-enabled device?

  • Cell phones
  • Smartwatches
  • Tablets/iPads
  • Devices that can access the internet, apps, or messaging platforms

 

What is the daily procedure?

  • Grades K–6: Students turn in their devices to their classroom teacher at the start of the day. Devices are stored in secure classroom storage.
  • Grades 7–12: Students turn in their internet-enabled devices when they arrive at school. Devices are stored in locked cabinets by school staff for the duration of the school day.
  • Devices are returned to students at the end of the school day.

 

Can students still use Chromebooks or classroom tech?

Yes. Every classroom is equipped with instructional technology, including Chromebooks. These are used for educational purposes and do not require students to use their personal phones or devices.

 

How can I contact my child during the school day?

If you need to reach your child during the school day, please call the school’s main office. Staff will assist with delivering your message.

 

What if my child needs their phone for medical reasons or other accommodations?

Exceptions may be made for documented medical needs or accommodations that are part of a student’s IEP or 504 Plan. Please contact your building principal or school nurse to begin the documentation process, if needed.

 

Are simple, non-Internet phones allowed?

Yes. Students may bring basic cell phones that do not have internet access. However, all personal communication devices, regardless of internet capability, must be turned in and securely stored during the school day. This ensures consistent enforcement and supports a distraction-free learning environment for all students. This requirement is outlined in both Board Policy 7208 and the Utica City School District Code of Conduct.

 

What happens if a student does not follow the policy?

If a student does not follow the procedures, we will work with them using a progressive discipline approach that prioritizes education and correction:

 

  • 1st Offense: Device is confiscated and returned to the student at the end of the day. Parents are notified.
  • 2nd Offense: Parents must pick up the device.
  • 3rd Offense: Detention is assigned. Parent pickup required.
  • 4th Offense and beyond: Additional consequences per the Code of Conduct.

 

In accordance with Board Policy 7208, students will not be suspended solely for violating the cell phone policy.

 

What about after-school activities or sports?

Devices will be returned to students at the end of the school day. If your child is staying for after-school programs, they will have access to their device after the school day ends.

 

Will the school be responsible for lost or stolen devices?

No. As outlined in the Code of Conduct, the school is not responsible for any lost, stolen, or damaged personal electronic devices.
